Privacy Policy

How Hoong Dai collects, uses, discloses and protects your personal data as a data user (controller), in accordance with Malaysia's Personal Data Protection Act 2010.

This Privacy Policy explains how Hoong Dai Commercial Services Centre (“Hoong Dai”, “we”, “us” or “our”) collects, uses, discloses, stores and protects your personal data when you visit our website, contact us, request a quotation, apply for a job, or engage our company incorporation, secretarial, accounting, tax, payroll and related services. We are committed to handling your personal data in accordance with the Personal Data Protection Act 2010 of Malaysia (“PDPA”), as amended. This Policy applies where Hoong Dai acts as the data user (controller) that determines how and why your personal data is processed. Where we instead process personal data on behalf of a client under a service engagement, our separate Personal Data Protection Policy (Client Data Processing) applies.

1. Who We Are

Hoong Dai Commercial Services Centre is a Malaysian corporate-services firm based in Johor Bahru, providing company incorporation, company secretarial, accounting and bookkeeping, taxation, payroll, e-invoicing and related services. For the personal data described in this Policy, Hoong Dai is the data user responsible for your personal data.

2. Consent (General Principle)

We will not process your personal data unless you have given your consent. By submitting your information through our forms (contact, enquiry, quotation, document checklist or job application), ticking the “I agree to the Privacy Policy” box, or otherwise providing your personal data to us, you consent to us collecting, using and disclosing your personal data as described in this Policy. Where you provide us with the personal data of third parties (for example directors, shareholders, employees or family members), you confirm that you have obtained their consent for us to process their data.

3. Personal Data We Collect

  • Identity & contact details — name, NRIC/passport number, residential and business address, email, phone/WhatsApp number, and (where required) gender and date of birth.
  • Business & corporate information — company name, registration number, and details of directors, shareholders, officers and beneficial owners, together with the documents needed to provide our services.
  • “Know Your Client” (KYC / due-diligence) information — where required by law to verify identity and beneficial ownership, we may collect copies of identification documents, nationality, tax residence, source of funds/wealth and related information.
  • Financial & accounting records — where you engage our accounting, tax, payroll or e-invoicing services.
  • Recruitment data — resume/CV, qualifications, work and education history, and any information you include when applying for a job.
  • Technical data — basic website-usage information collected through standard server logs and essential cookies.

Some of the above may be “sensitive personal data” under the PDPA (for example information about health or, following the 2024 amendment, biometric data). We collect sensitive personal data only where necessary, and with your explicit consent or as otherwise permitted by law.

4. Purposes of Processing (Notice & Choice)

We collect and process your personal data for the following purposes:

  • To respond to your enquiries, prepare quotations and provide the services you request.
  • To carry out company incorporation, secretarial, accounting, tax, payroll, e-invoicing and related compliance work.
  • To perform our contract with you and administer our client relationship, including billing and record-keeping.
  • To meet our legal, regulatory and statutory obligations, including KYC / anti-money-laundering checks and filings with authorities such as SSM, LHDN, KWSP/EPF and PERKESO/SOCSO.
  • To assess and process job applications.
  • For our legitimate business interests, such as improving our services, and maintaining security and preventing fraud.
  • With your consent, to send you service updates or information about services that may interest you.

Providing your personal data is voluntary. However, if you choose not to provide the data we require, we may be unable to respond to you or provide our services.

5. Marketing Communications

We will only send you marketing communications by email, WhatsApp or other electronic means where you have consented, or where otherwise permitted by law. You may withdraw your consent or unsubscribe at any time, at no cost, by contacting us using the details in the last section — this will not affect the lawfulness of any processing carried out before your withdrawal.

6. How We Share Your Personal Data

We keep your personal data confidential and do not sell it. We may disclose it, only where necessary, to the following categories of recipients:

  • Government bodies and regulators as required to deliver our services or comply with law (e.g. SSM, LHDN, KWSP, PERKESO, Royal Malaysian Customs).
  • Professional advisers, auditors and appointed service providers (including IT, software and cloud providers) who assist us, under confidentiality obligations and only in accordance with our instructions.
  • Any party where disclosure is required or permitted by law, or in connection with legal proceedings.
  • A successor entity in the event of a merger, acquisition, reorganisation or transfer of our business or assets.
  • Any other party where you have given your consent.

7. International Transfers of Personal Data

Your personal data is generally stored and processed in Malaysia. Where our service providers (for example cloud, accounting or payroll software providers) process personal data outside Malaysia, we will take reasonable steps to ensure that the transfer complies with the PDPA and that your personal data continues to be protected by appropriate safeguards.

8. Security

We take practical steps to protect your personal data from loss, misuse, unauthorised access, modification or disclosure, through appropriate physical, technical and organisational measures. We also require third parties who process personal data on our behalf to keep it secure and confidential.

9. Retention

We retain your personal data only for as long as necessary to fulfil the purposes above and to comply with legal, accounting and tax record-keeping requirements under Malaysian law. Accounting and tax records are generally kept for at least seven (7) years, and KYC / customer due-diligence records for the period required under applicable anti-money-laundering law. When no longer required, your data will be securely destroyed or permanently deleted.

10. Data Integrity

We take reasonable steps to ensure the personal data we hold is accurate, complete, not misleading and kept up to date. Please help us by informing us of any changes to your personal data.

11. Your Rights (Access & Correction)

Subject to the conditions set out in the PDPA, you have the right to:

  • request access to the personal data we hold about you;
  • request correction of inaccurate, incomplete, misleading or out-of-date data;
  • withdraw your consent, or limit the processing of your data, at any time;
  • require us to stop processing your personal data for direct marketing;
  • where applicable, request the transfer of your personal data to another party (data portability); and
  • enquire about how your personal data is being processed.

To exercise any of these rights, please contact us using the details in the last section. We will respond in accordance with the PDPA. Please note that withdrawing consent may mean we can no longer provide certain services to you. You may also lodge a complaint with the Personal Data Protection Commissioner of Malaysia if you believe your rights have been infringed.

12. Cookies

Our website uses only minimal, essential cookies and standard server logs needed for the site to function. We do not use cookies to build advertising profiles of you.

13. Changes to This Policy

We may update this Privacy Policy from time to time. The latest version will always be published on this page with the “Last updated” date.
